turned out to be faulty. 
o2 being unhelpful

Been to apple 5 times and apparently fixed. However fault is still there. Got the phone from o2 online. Now they want to repair it 😂

Of course, whilst the retailer who sold you the 'phone will often try to send you to the manufacturer, your legal rights under the Sale of Goods Act are against the retailer. Hence, your dispute is with O2 and that is where your legal rights lie.
