I had had a contract with o2 a few years, so decided to upgrade on 17th Sept to iPhone 5. The same week I was made redundant, so contacted o2 who told me to return to my local Carphone Warehouse store. I did this and received a refund on 24th Sept.
I then began to get calls from o2 saying I had not taken ut back, so had to visit Carphone Warehouse store, complete over a dozen on line chat transcripts and finally contact Carphone Warehouse direct who confirmed I had returned it. This despite my bank statement already showing I had been refunded by Carphone Warehouse.
I spoke to my solicor and was told to ask o2 for a written apology and compensation, this I got on 1st October with £276 compensation paid directly into my bank.
All done and dusted you may think?
No, yesterday I got a FINAL DEMAND asking for the full money of the contract I never took out, returnining it within 14 days. I have spoke to o2 again, this time they have no record of the phones return yet again and have no knowledge of an apology they made or a refund they gave.
I've been to see my solictor again and due to my ill health is going to prosecute o2 for harrassment.
As well as this, for the third time Ive contacted BBC Watchdog and Ofcom.
I have never ever known service or corruption like this. I have a job as a chemical engineer now and earn £30k per year, but the only time these inept people will see my bank account is when they are forced to give compensation again.
I won't be settling for what ever they offer this time, I will leave it to the court to decide.

Cheers. I've been on to Ofcom and been given an email address. They have told me they will sort this out independantly. I'd love to hear their reasons for crediting my bank account with refunds and sending apologies. I wanted this sorted quick, but kinda hope it goes to court now.

Just thought of this and this will be a good one for them to explain. Why did they provide me with a Pac Code to leave if my account was not in balance. Also, why is my account not active on MyO2 anymore if there wasd outstanding finance on it?
To call this firm cowboys would be an insult to cowboys.

Hold on, something is missing here. With whom did you take a contract and where? If it was with CPW then its their error and o2 are only acting on what they get from the CPW system.
You would get a PAC if you have terminated the contract and then any outstanding monies would be taken a month or so later e.g. international calls once the PAC was used.

If it's already in the hands of solicitors and the regulators are already involved, you'd be best advised to let them deal with it. In particular, you should be careful of making public statements about the events and the case - you don't want to risk prejudicing your case. Let your solicitors do the talking in the right way and in the right place - that's what you pay them for.

I agree with steersy and pengipete, you need to calm down and let any court deal (if it ever gets that far) with this.
Any solicitor would tell you this, and at the worst it's simply a mistake by whoever you're dealing with and they need to be given time to deal with it.

If the issue is being dealt with then let them get on with it. Any comments on here could prejudice any legal actionyou are contemplating. I think we've got the point you are making.
