Hi, My current O2 contract is up shortly and I am looking at a 5s on Refresh.
We do not have 4G in my area at the moment, so starting on a 3G contract would seem sensible.
However, assuming 4G gets to my area in the next 24 months, does anyone know if I will be able to upgrade the contract to a 4G service without having to pay off the phone credit agreement? It appears from the ToB, that this is necessary for any changes to the service contract

If you take out a 4G contract by tomorrow 31st Oct you would get the extra data allowance, see "Extra data for early birds" here:

You can convert from a 3G to a 4G tariff by paying an extra £5 a month. However your data limit will remain as it was originally on the 3G tariff. As others have said O2 are currently offering more data if you sign up to a 4G tariff now which may appeal to you. I have the 8GB 4G tariff on my phone and don't live in a 4G area (although I did briefly visit an area where they were testing the 4G ready for launch yesterday)

You can do that, I can't find the offer but here are the terms that apply:

This only lets you use the existing amount of data in your tariff on 4G, it does not provide any more.
